Cerebral Palsy medical negligence case settled for £1.73 million

Brendan Kearney acted on behalf of a child who suffered brain damage at the time of her birth at Altnagelvin Area Hospital. The case had been with another legal practice originally, however the child’s parents were not satisfied with the level of service they were receiving and transferred the matter to Brendan Kearney & Co.

Brendan quickly progressed matters and obtained the necessary obstetrics expert medical evidence which confirmed that the child’s birth had been delayed due to errors in management of the delivery.

Further expert medical evidence obtained in the case confirmed that this delay resulted in a brain injury due to a lack of oxygen to the child and ultimately led to a diagnosis of Cerebral Palsy. After protracted negotiations with the hospital’s legal representatives – which took into account issues such as; future care needs, occupational therapy, accommodation adjustments and many more – the matter was settled and the child was awarded £1.73 million in damages. The parents of the child deemed this a very satisfactory outcome and felt the settlement would go some way in helping them, and their daughter, deal with the lifelong challenges ahead.
