Magistrates Court Defence, Derry/Londonderry
Prosecutions for all offences commence in the Magistrates Court with the vast majority of minor criminal cases being dealt with before a District Judge (formerly a Magistrate). Our solicitors are highly experienced in representing clients in a broad spectrum of criminal matters. We advise and represent clients throughout the course of cases which routinely include entering pleas of guilty, contesting cases and committal proceedings.
Applications for legal aid will be made for those clients who may be entitled to it. Our experience of Magistrate Court cases includes representation of clients for offences such as disorderly behaviour, common assault, more serious assaults, theft, benefit fraud and motoring crimes. We represent clients both in and beyond Derry/Londonderry and will continue to advise clients when considering any appeal.
Crown Court Defence, Derry/Londonderry
Although the majority of criminal cases in Northern Ireland are heard before a District Judge, there are circumstances where the gravity of the offence means that the case will be tried in the Crown Court either with or without a jury. Any persons charged under the Terrorist Legislation will have their case dealt with by a Judge sitting without a jury known as a Diplock Court. In some instances such as theft or relentless assault, clients can elect to have their cases tried before a jury.
Brendan Kearney & Co. Solicitors will assure you of a dedicated, expert and professional approach to what is a trying and uncertain time. In addition to offering representation at trial, we can also advise our clients on what they can expect from the process at each stage of proceedings and the consequences of such. Our service extends to advice and representation when considering appealing against sentence or conviction.
